<div>Well, when you are dealing with the lenders both song and game fits.  IAMB Inc., received consumer reports that will show information of the lenders cross solidifying their front to cover each other.  Meaning Lender B letter to a consumer on Lender A letterhead, stating that Lender B will cover the acts of Lender A.  Confusing, try being the consumer getting this confusing letter and asking, &#8220;Who do I pay?&#8221;  As foreclosure process begins.</p>
<div>All consumers, signed a &#8220;Servicing Agreement&#8221; that gave rights to all lenders to service (hand off) your loan as they see fit, when they see fit, to whom they see fit, with or without your permission, or proper notification.  How is that?</div>
<div>The Government is waiting are you responding and reporting these acts against consumers to the agencies that can help preserve your rights?</div>
<div><span style="color: #ff0000;"><strong>RED ALERT:</strong></span> In all the chaos and confusion, some States Consumer Affairs Divisions are quietly closing, better check your rights they are diminishing.</div>

<div>Well, low and behold it was not free money.  The money was interest free, payment free, but the money had to be paid back.  Some cases of long term ownership negated the repayment, but that was a rare situation, most cases the Government will recaptured all that was loaned.</div>

<div>Now, I hear that the Government is giving out FREE, home loan Modifications.  Not only trying to block hundreds of thousands of Mortgage Brokers out of business, again, only those consumers who &#8220;qualify&#8221; will have their loans looked at.</div>

<div>Consumers, FREE, means FUNDED, means you do not get a FULL BENEFIT!</div>
<div></div>
<div>Go ahead, add it to your tab, American Consumers, but remember, paybacks are a bitch!</div>

<p>The State governing agencies that work on behalf of the citizens, sadly, can&#8217;t get it together in these hard times to protect one another&#8230; let alone the consumers.</p>
<p>Take a look [above link] at how one States&#8217; Attorney Generals Office can only inform consumers on what not to do, in avoiding foreclosure scams.</p>
<p>In a round about way, the State informs that &#8220;<em>if a consumer is to use a State License Mortgage Broker check with the Mortgage Lending Division.</em>&#8221;</p>
<p>Why aren&#8217;t States informing citizens that this is the <strong>States&#8217; only defense against predatory practices</strong>, as if you, the citizen, know whether or not you are hiring a source that is under their jurisdiction.</p>
<p>Instead, no one is trying to tell the consumers the skinny!</p>
<p>Believe me consumers, it is ok to use a State Licensee for modificaton and foreclosure rescue, or this letter would not have mentioned a word about the source.</p>
<p>The States [are suppose to] work on behalf of the people; the States Representatives should be allowed to clearly speak and educate consumers to the State for good help resources.</p>
<p>If citizens were educated to know that <em>with a State Licensee helping you</em>, you <strong>do</strong> have some recourse (and some one liable) for your case.  With Federal Agencies you have no recourse, and basically, you are SOL. <img src='http://renastarks.com/wp-includes/images/smilies/icon_sad.gif' alt=':(' class='wp-smiley' /> </p>
<p>Citizens, because you demand nothing together, you get little in return!  Remember, united we stand and divided we will fall!  Let&#8217;s reunite!</p>

<p>Consumers, you mean to tell me that the lenders are playing the same Interest Only/ARM game that got us into this &#8220;State of the Economy&#8221; in the first place?</p>
<p>Reports will show the modifications trends are Trial/Step/Preliminary Loans, that will only pay the penalties to the lender of the foreclosure process and you might not believe this, these newly named loans will adjust.</p>
<p>My questions to all those who seek re-election: Who makes the reports of the lenders to you? Does anyone really have &#8220;your backs&#8221; and are they truly reporting in this game they are playing?</p>
<p>Once the date is Nov 2012, then this is going to be important to everyone, especially the consumers, who, at that time, <em>will</em> be repeating this foreclosure crisis that first got you elected for that &#8220;change&#8221; we were promised.</p>
<p>Just my unsolicited questions, thoughts, and now opinions as some state &#8220;the economy is getting better&#8221;, sorry to burst all bubbles&#8230;</p>
<p>Of course, it is in my opinion&#8230;</p>
<p>These quick fix loan modification products are the same quick loan sale products that got American homeowners into this once (incorrectly) labeled &#8220;Dream&#8221; &#8212; or as we now relate to as &#8220;Home Rescue and Affordability!&#8221;</p>

<p>I mean, this new modification actually is a new NOTE, that should supersede to take the place of the Old NOTE, shouldn&#8217;t it?</p>
<p>What happens to the Old NOTE, really?  Because this new NOTE, does not seem to give consumers their right of redemption, it seems to <span style="text-decoration: underline;">pre-empts</span> or <span style="text-decoration: underline;">negates</span> the right of the consumers?</p>
<p>Should a lender&#8217;s closing agent or third party closer, who understands and can explain the New NOTE to the consumer, be present at the signing of this new NOTE?</p>
<p>Hey, I have questions too&#8230;I&#8217;m listening, but unfortunately the Lenders won&#8217;t give true answers.</p>

<p>Time for some education on how to access help, since you will need to know the secret: &#8220;<em>Wow, I&#8217;ve got to love the States, they truly supply what is necessary to protect me!</em>&#8221;</p>
<p>Under special and certain conditions help for consumers is handled by your states&#8217; Attorney General office.</p>
<p>You must rely on those who pay close attention to the crisis daily to protect you.  You have a &#8220;free&#8221; Attorney and he/she is in control of your State.</p>
<p>Remember, the Exempt Status Lenders are truly exempt.  You might want to take a moment and look the word up in the dictionary.  Exempt is a strong word and it fits the lenders.</p>
<p>Any concessions that will be made by the exempt status lenders will come with a specific road map.  However, it seems like we are under-construction every Friday.  We must continue to stay strong in our fight against the ESL.  If we don&#8217;t, who else will?</p>

<p>Some lenders will attest have already conceded.</p>
<p>All lender exemptions are being granted under 30, 60, and 90 day Stays, to each Exempt Status Lenders.</p>
<p>IAMB plea, on behalf of the consumers, who continue to be the collateral in this takeover through foreclosure, that the Legislators continue to not grow weary in well doings, press onward to keep continued, needed and wanted help coming.</p>
<p>IAMB, Inc recognizes all efforts especially the AG of NY, who stepped up to say, &#8220;enough with the exemption&#8221; in their State.</p>
<p>Consumers depend upon us to investigate and inform Legislators, who worked hard for consumers, that they might be being undermined, back-doored or even deceived!</p>

<p>&#8220;You might want to check out the new Legislative Workshops in 44 States and counting.  The new Legislation will make [or have made] State Licensed Mortgage Brokers responsible for doing modifications.  Just check out what Nevada&#8217;s AB152 says.  Thanks for the offer to cut our pay!  But, I am a Licensee, who has been fighting Attorneys that are doing Foreclosure and Modifications for consumers.  Mortgage Broker Licensees should modify the loans while the Attorneys should file lawsuits.  Thankfully, the States are beginning to see it this way also.&#8221;</p>
<p>In some States, such as Nevada, if Attorneys conduct a modification, they might not be exempt, and will need a License to conduct business in foreclosure rescue.  But Licensees do not need Attorneys to conduct the business of Loan Modifications, Loss Mitigation, or Foreclosure Rescue.</p>
<p>An educated licensee knows how to cure a default, stop a foreclosure sale, save the lender and consumer money, and most of all when no resolve is possible, all negotiations have been exhausted, and the lender just will not comply, the licensee, knows how to direct a consumer to retain an attorney and supply the Attorney with the forensics to win for the consumer.  This makes a plus for licensees.</p>
<p>Just think if you decide to become educated and really go after the lenders [who are all serving the "one" beneficiary of lending!]  I also say get educated for the mere question of: did you know some lenders are exempt from your lawsuits?</p>

<p>The actions of fear, that make a consumer call the lender to check on their modification refinance status, will supersede all the arrangements made on the account by a modification company on the consumer’s behalf.</p>
<p>The lender will cancel out the modification company’s power of attorney on your account causing the modification company to re-work by being re-added to your account, to start all over.</p>
<p>Some consumers may think they are saving money by jumping in and picking a plan to close the deal, but do not realize that at this present time there are more options than “The Obama Plan”.  There are the HASP, HMP, MHA, HEMP, as well as others that come out daily.   The Obama plan is not intended for investors, so if this is the chosen plan there are limitations that knock the modification company out of a chance to help keep any non-owner occupied homes.</p>
<p>The lender will ask for the same compliance items direct from you the consumer that the modification company will ask us the modification company to supply.<span> </span>This is because you call direct to the lender out of paranoid fears.<span> </span>Calling direct releases the modification company because of what you the consumers did on your own behalf to be noisy.<span> </span>Yet, because you, the consumer called the lender and made your choice on a plan, “to save your home,” now, you may feel that the modification company isn’t due pay, even though the modification company had picked the most beneficial plan for you.<span> </span>You the consumer blew it with your curiosity.<span> </span>You may have heard this one, &#8220;curiosity killed the cat,&#8221; and now your wanting to check on the status has killed your deal!</p>
<p>Ever hear the phrase: “Pride comes before the fall”?<span> </span>-<span> </span>When a modification company cancels you for non-payment, then best of luck!<span> </span>You can do it better as a consumer, well best of luck in the venture!<span> </span>The Negotiators will know best way to manipulate the modification.</p>
<p>If the lender limits education on the plans or options that the lender gives to consumers, why call the lender and choose a plan?<span> </span>If you the consumer already know the education, why not just do it all from the beginning for yourself and save both you the consumer and the modification company time and headaches with frustrations?</p>
<p>The fact that consumers stop payments on checks or file wrongful claims to credit card companies to get money back from good negotiators has now cause extra issues for consumers, the modification company are charging all charges upfront, with the States approval.<span> </span>It use to be that the State told you the consumer not to pay for upfront fees on loan modifications.<span> </span>This was an error that has been corrected.<span> </span>Because in many cases after the modification is received and the consumers decide not to pay, but got to keep their home.<span> </span>If consumers call the lenders more than likely the modification company will be held harmless, for wrongful actions caused by consumers themselves.</p>
<p>What happen to a file when a consumer calls:<span> </span>the file goes from verbally being pre-approved and waiting written confirmation, to now worry if the right plan was picked or if the modification process should be restarted, because of consumer fears that leads to interference with due processes - not a good thing!</p>
<p>The lenders confirm immediately with the modification company that you the consumer has interfered to stop all processing with your phone call to them.<span> </span>Lenders will verify with the recorded conversations and “laugh” as they show consumers non-compliance to the modification company.<span> </span>The lender knows unless the consumer knows what they are doing, they (the lender) will ALWAYS, win - every time!</p>
<p>If you want involvement in your modification process, going forward, you should contact your modification company, ask if they have any evidence that the lender, that they have spoken to on your case, and if can they share this evidence - if you do not have someone to help you do this - you can always call the safe services providers at Homekeepers LLC at 877.702.5337.</p>
<p>Remember, you always have the “right to choose” just not the consequences.  Consumers, unless you know all the products that the lender houses, why take a chance on hurting yourself in your fear?  Educate the fear away.</p>

Consumer: &#8220;The lender!&#8221;</p>
<p>When I hear someone relate &#8220;they&#8221; to someone whom is the bearer of bad or disturbing news, it reminds me of an old crazy song from a skit on a late night show I use to watch. The host started the show with, &#8220;They&#8217;re coming to take me away, ha-haaa!!  They&#8217;re coming to take me away, ho-ho, hee-hee, ha-haaa - - To the funny farm. &#8221;</p>
<p>Maybe the remembrance of this skit dates me in age, but unbelievable how it still holds relevance to what &#8220;they&#8221; (the Exempt Status Lenders) are doing today, in driving consumers over the edge, giving only partial [or no] information.</p>
<p>&#8220;They&#8221; said, &#8220;the lender is going to take my house!&#8221;</p>
<p>&#8220;They&#8221; said, &#8220;no one has contacted them on my behalf!&#8221;</p>
<p>&#8220;They&#8221; said, &#8220;I do not qualify for a loan mod.&#8221;</p>
<p>&#8220;They&#8221; said, &#8220;why do I need any company to do what I can do, which is work with them to modify my home?&#8221;</p>
<p>&#8220;They&#8221; said, &#8220;the Lender will send the Sheriff to throw my stuff on the streets!&#8221;</p>
<p>&#8220;They&#8221; said, &#8220;I am going to lose my home.&#8221;</p>
<p>&#8220;They&#8221; said, &#8220;do not to pay any company for working for you?&#8221;</p>
<p>They said, they said, they said&#8230; enough of  this &#8220;he said, she said&#8230;&#8221;</p>
<p>Here are our facts:</p>
<p>Consumers are in a panic and stir as they run to report what the exempt status lenders [who are "they"] are saying.  The &#8220;new&#8221; ESL, who is just now getting to contacting customers, themselves, have acquired multiple loans from previous exempt status lenders.  This was done either through 1. purchase or 2. a take over processes.  Now <em>they</em> are calling consumer borrowers to let them know that <em>they</em> have now taken over their accounts and that no one has contacted them on their behalf (as <em>they</em> are the new servicer lender).</p>
<p>Of course, this is absolutely correct, &#8220;NO ONE has contacted this new lender or servicer?&#8221;  What needs to be handled first is clarification of who <em>they</em> are, if <em>they </em>are the new lender and if <em>they</em> hold the NOTE, or if <em>they</em> have only taken over as the new Servicer and the original lender has not change.</p>
<p>&#8220;<em>&#8220;They&#8221;</em> sent me a Notice!&#8221;  Was this noticed Signed or unsigned?</p>
<p>In order to get your attention and for you to quickly comply, <em>they</em> will send a Notice of Intent to Accelerate, or a Notice of Default, even a Notice of Trustee Sale.  I suggest that a phone call is in order for your current modification company, let them know that <em>they</em> (the old lenders) have changed and <em>they </em>(the new lenders) need attention.</p>
<p>&#8220;<em>&#8220;They</em>&#8221; say that <em>they</em> are going to send the Sheriff to kick me out of my house?&#8221;  Thank the Law that <em>THEY</em> have to take you to Court first.</p>
<p>Remember: the ESL is only exempt towards certain parts of the law.  Due process (or course set for action) must happen.  You must receive written warning and notifications of non-compliance before the Constable or Sheriff come to kick you out.  If you have received a 3-day Notice but never received documents to go to Court for an &#8220;Unlawful Detainer&#8221; and no one can show you a &#8220;WRIT&#8221; that the Judge signed for you to leave, then you do not have to leave your property.</p>
<p>You must fight!  (By filing a &#8220;Motion to Stay the Eviction&#8221; or a &#8220;Motion to Appeal&#8221; the process.) Support your local Law Library or go to the Clerk of Courts, both places should be able to give correct information, what papers you need to file, on the &#8220;how to stop&#8221; actions of the foreclosure and eviction process.</p>
<p>Is this legal if they have already taken control of the account?  Well, this is where I support the Attorneys, you will need to hire an attorney so that they may help to figure that question out.</p>
<p>Once you file the papers, take the filed documents to the Constables Office (or similar depending on your state).  Have the correct Office add to any relevant paperwork to the property records.  The Constable will never show up to evict you, until this matter of foreclosure has been heard, by the Courts.  <span style="text-decoration: underline;">Make sure to take this step because the Constable does not have a crystal ball and can only go by what is reported to them.</span> <strong>REPORT!</strong> If you get any more 3-day postings, take them to the Police, file an incident report of illegal process of law and entry.</p>
<p>These people coming to your door are REALTORS!  If they do something out of order, report them to the Board of Realtors.  The ESL&#8217;s do not want them to act as thugs and thieves, they are suppose to be making sure the process is going smooth for transition.  If you want to move, they <em>can</em> offer you &#8220;Cash for your Keys.&#8221;  This means you will civilly move and take cash to turn over the property you deem no longer  yours (renters included).  If you do not choose to do cash for keys, then what I wrote earlier is true, the fight is on - file the reports.  Then get an Attorney, quick.  Good Luck!</p>
<p>Remember, when it comes to the new boogie man aka <em>they,</em> &#8220;they&#8221; have to obey the laws and, &#8220;they&#8221; can only do (and get away with) what you allow them to!</p>

<p><strong>This information explains how to file a &#8220;Motion to Stay&#8221; in the Eviction Order process.</strong></p>
<p><em>Tenant General Instructions</em></p>
<pre><span style="text-decoration: underline;"><strong>Apartment 1 of 7</strong></span></pre>
<p><span style="text-decoration: underline;">WHAT IS A MOTION TO STAY?</span></p>
<p>Normally, after the court signs a summary eviction order, the order goes to the clerk&#8217;s office and is then sent to the sheriff or constable for enforcement. The statute states within 24 hours from the receipt of the order the sheriff or constable must enforce the order.</p>
<p>That means the sheriff or constable will lock you out within (or as distinct to from after) 24 hours. Form #26, Motion to Stay Eviction Order, is used to request the court to delay the enforcement of its summary eviction order.  The Motion is your chance to tell the court why you need more time and why immediate eviction would be a special hardship for you.</p>
<p>If a stay is granted, that means that the eviction order cannot be enforced until the date indicated by the court.  After that date the sheriff or constable will (again) lock you out.</p>
<p><span style="text-decoration: underline;">HOW MUCH TIME IS THE COURT AUTHORIZED TO DELAY THE ENFORCEMENT OF ITS EVICTION ORDER?</span></p>
<p>Under Nevada Revised Statutes (NRS) 70.010, a Justice of the Peace can stay an order for up to 10 judicial days* from the date of the eviction order. The time granted, if any, is totally within the court&#8217;s discretion.</p>
<p><span style="text-decoration: underline;">WHEN SHOULD YOU FILE THIS MOTION?</span></p>
<p>You need to file this Motion to Stay Eviction Order, Form #26, as soon as you can if you think the court is going to evict you. You may file this Motion whether or not you also file(d) a Tenant&#8217;s Affidavit/Declaration opposing the eviction.  <em>If you also file a Tenant&#8217;s Affidavit/Declaration contesting the eviction, you may also include your request for a stay in that document.</em></p>
<pre><strong><span style="text-decoration: underline;">Apartment 2 of 7</span></strong></pre>
<p>If you have no defense to the eviction and do not file a Tenant&#8217;s Affidavit/Declaration (perhaps you have not been able to pay your rent) and if you wish the court to consider your request for a Stay, you should file your Motion for Stay before the end of the time period during which you are allowed to file your Tenant&#8217;s Affidavit/Declaration.   This way, the court will have your Motion when the landlord files his/her Landlord&#8217;s Affidavit/Declaration requesting an Eviction Order.   Certainly you should file this Motion before the sheriff or constable have actually locked you out.</p>
<p><strong><span style="text-decoration: underline;">FILLING OUT FORM #26</span></strong></p>
<p>Heading - Fill in the name of the township and county of the Justice Court as set forth on the Five-Day Notice of Unlawful Detainer that was originally served on you by the landlord.</p>
<p>Parties - You must fill in the names, addresses and phone numbers of the Plaintiff and Tenant/Defendant as set forth on the Five-Day Notice of Unlawful Detainer that was originally served on you by the landlord.</p>
<p>Case No. and Dept. No. - Use the identical Case Number and Department Number as was assigned on the Five-Day Notice of Unlawful Detainer that was originally served on you by the landlord.</p>
<p>Body of the Motion -  Put your name in the first blank.  Check either Number 1 or 2 to indicate whether the court has already ordered an eviction or that you anticipate an order.  If you select Number 1, fill in the date.  If you select Number 2, that you anticipate an eviction and you are not filing a Tenant&#8217;s Affidavit/Declaration, you should attach the Notice you received that told you that you would have to file a Tenant&#8217;s Affidavit/Declaration with the court to acquire a court hearing. That Notice should advise you when you have to file.</p>
<pre><strong><span style="text-decoration: underline;">Apartment 3 of 7</span></strong></pre>
<p>You should attach that Notice to the Motion to help the court identify which eviction action your Motion to Stay relates to.   Then put the number of days (no more than ten) that you wish the court to stay the order.  The number of days should be based on the statement of your circumstances that you provide in the Tenant&#8217;s Affidavit/Declaration.</p>

<p>This person said to me, &#8220;How did we allow this to happen?&#8221;</p>
<p>I went over the process of &#8220;how&#8221; this could possibly happen.  After I did, whoa, this person shut down.</p>
<p>This person stated, that what they meant was they have friends who went out and pulled the &#8220;buy + bail&#8221; to get &#8220;another&#8221; home that was affordable.  For those who do not know the buy + bail routine, it stems from the lenders teaching Licensed Mortgage Brokers how to beat the system.  What is not understood, however, is that the lenders must take responsibility.</p>
<p>The lender loaned money [in scenarios] that &#8220;they&#8221; (or someone in charge of the money) should have had more quality control over.  With regulatory insight, and assurance, that would have made consumers think before accepting loans that overly-inflated their income, to fraudulently purchase an inflated home.</p>
<p>I involved the other person sitting next to us on the plane, to use them, as the banker, in my scenario and skit.</p>
<p>I presented the &#8220;banker&#8221; (lender) with a possible lending case and stated that &#8220;I have this client, with great scores and credit history, I voiced that I would not like to disclose any further information about the client, except the fact that they might have assets.  I then asked the [passenger] banker if they would loan money to this client?</p>
<p>The passenger laughed and said, &#8220;In no way would they participate in this kind of lending.&#8221;</p>
<p>&#8220;That is what I am talking about,&#8221; I said.  &#8220;Of course, today, lenders would not allow this, however at the &#8220;height&#8221; in the lending industry, lenders were just as quick to open the doors of their policies and that is what got us into this.&#8221;</p>
<p>And actually, only those consumers with money and good credit were privileged to be the ones who had the ability to participte in this buy and bail scam, and in turn, allowed them to walk away from their previously owned property.</p>
<p>The average homeowner [who does not possess the savvy, credit, and/or the money] cannot and could not have pulled this slick, hazardous venture off.   And again, wouldn&#8217;t you need to be educated on buy + bail in order to participate in a buy + bail?</p>
<p>The bottom line is that, responsible lenders should have trained [educated] on this process of funding these loans&#8230; But either way, the conversation, for me, was very intriguing and stimulating; I can&#8217;t say that for the person to whom I was educating, their attitude became strongly disagreeable and heated.  I found it to be quite humorous, that they turned their back, and pretended to be busy with their puzzle and &#8220;slept&#8221; for the rest of the flight.</p>
<p>So, to answer their question of &#8220;How did we allow this to happen?&#8221;  It only takes some [people] to keep all our heads in the sand and refusing to believe that the lenders have allowed and are at the bottom of this.  The ESL possesses all the guidelines, power, and the answers to (or not to) lend, along with how &#8220;they&#8221; can construct the deals!</p>
<p><span style="text-decoration: underline;">Blame Game Litmus* Test</span><br />
1. Who approves you for a loan according to their guidelines?<br />
2. Who told the person you were working with, that &#8220;there are no conditions the bank needed&#8221; (conditions&#8230;proof of income, down payment, bank statements, etc.) in order to get your loan closed and funded?<br />
3. Who consummated to seal the deal by funding?<br />
4. Who continues to gain?</p>

<p>Maybe as consumers, we should stop giving ourselves such high credit, stop blaming, and stop being haters of those consumers who fell for &#8220;it&#8221;.  Or those who did willingly participate, in the &#8220;<em>whatever</em>&#8221; kind of lending, to get into their &#8220;dream home&#8221; and now will participate in the &#8220;<em>whatever</em>&#8221; kind of help, to try and save their livelihood.  (sanity, home, and money)</p>
<p>All this, because some try hard to not become, or fall into, the collateral status that the ESLs both labeled and predicted [some of us] would become.</p>

<p><em><span style="font-style: normal;">In his own frustration, my client went to an &#8220;Attorney Modifier&#8221;, and this attorney told the client that he couldn&#8217;t do anything for him, after he had already paid him twice the amount of my costs</span> and<span style="font-style: normal;"> took over power of attorney from me.  The client came crying back to us claiming, &#8220;I didn&#8217;t know!&#8221;  (He knew&#8230;) We did finish this file for the client, and in almost a five day period, our company received a modification package and saved his home.</span></em></p>
<p>Would you believe that the client still tried to give the credit to the an Attorney?!  I know that the Attorney was elated to take this credit.  The client does not realize that not many people, rarely even those in the judicial systems have resolved a loan modification in 30 days, let alone five.</p>
<p>Oh well, thus the culture that makes up our U.S. Citizen purchasers proves we need to educate further to help those who just do not understand.  Our office <em>is</em> cultured, with interpreters [and we're always looking for more] to educate us and help us on our journey to educate on how <em>their culture</em> sometimes doesn&#8217;t want to believe that Attorney&#8217;s don&#8217;t have the capabilities to complete modifications, and in a week?  That would have been an impossibility!</p>

<p>Do idioms only ring true in literature, or can we use that as evidence in court?</p>
<p>I was in Court today with:</p>
<p>1. The Modification Agreement that the lender had sent to the client<br />
2. The Money Transfer Number (MTN) for verification that the agreement was consummated by the down payment<br />
and<br />
3. The recording that the lender had agreed to the modification.</p>
<p>We were in court, because the Lender had decided to change their mind, and foreclose even after allowing us to believe everything was to be ok.  Now, we are seeking a &#8220;WRIT&#8221; which causes the legal eviction of the borrower.</p>
<p>The Judge stated and the Attorney echoed, &#8220;This document is not legal, because all parties did not sign, though the borrower signed, the lender did not, thus the document cannot be honored!&#8221; I said to myself, &#8220;WTF?&#8221;</p>
<p>If this is true, then no NOTE (or loan closed) is legal, because no consumer can produce a NOTE with the lenders signature and their signature.  The Lender could sign now, but in my twenty-two (22) years of closed loans, no parties were ever privy to a fully executed contract.</p>
<p><strong>WHERE IS THE LEGAL SYSTEM THAT WILL EVALUATE THIS?</strong><br />
<strong>Who is going to straighten this mess?</strong></p>
<p>As time goes on, the light is being shed on all kinds of relevant facts that could save the consumers - how do we rectify this wrongful act?</p>
<p>Every closing in America happened without the lenders&#8217; signature on the NOTE - the borrowers have contracts that are not contracts because the lender did not sign?  (If that&#8217;s the way it is for a modification, why not the actual loan itself?)</p>
<p>When you go to Court, Consumers/Borrowers, take your original NOTE to the Judge and question if the first contract is not valid.</p>
<p>If a Modification Agreement is no good because it is not signed by the lender, then is the unsigned NOTE a legal and good document to foreclose upon?<br />
That is for the Judges to come together and answer!  I can only continue to scream, &#8220;HELP THE CONSUMER!&#8221;</p>
<p>If one agreement unsigned is no good, then the other documents unsigned are no good, unless the lender can show service to the consumer/borrower that would have both signatures?</p>
<p><span style="text-decoration: underline;"><em>What&#8217;s good for the goose:</em></span> No good Modification Agreement because the document is not signed by both lender and consumer&#8230;<br />
<em><span style="text-decoration: underline;">Is good for the gander:</span></em> No one in the original transaction of the first loan closing - not lender, nor consumer/borrower - can produce the original NOTE (signed at that closing) by the lender and the consumer borrower.</p>
<p>If this is true - Then consumers [because of the lenders errors and omissions] just received the largest bailouts in the history of banking, justifiably so by the Courts and Laws of records, per the Judges.  I have produced countless copies of Modification Agreements - NOTES - so, because of this Judge, let&#8217;s show evidence to keep the home legally - were you not under a legal contract to begin with?</p>
<p>I do not believe in propaganda in this fight for the home&#8230;&#8230;&#8230;but, with the Judges statement, is this really true, did I finally hear a part of the law that could help all, does all lender documents have to have both signatures to be legal, really?</p>
<p>Well I say, &#8220;Show me the Signatures!&#8221;<em> &#8230;or allow the unsigned Notes to be re-evaluated.</em></p>

			<content:encoded><![CDATA[<p><img class="alignleft size-full wp-image-236" title="building-success3" src="http://renastarks.com/wp-content/uploads/building-success3.jpg" alt="building-success3" width="242" height="181" />Attorneys should sue the lenders - Judges should rule on the Lawsuits - Licensed Mortgage Brokers (those who know the lender, their guidelines, &#8220;how to&#8221; work with the lenders and those who know the lender products) should be the ones called upon to modify the consumers (who do not wish to work with the lenders direct.)</p>
<p>One thing Attorneys are, are experts on law. Mortgage Modifiers should be State Licensees, because the lenders trained them to do what is right (and what was wrong.)</p>
<p><span style="color: #800000;">Scenario: Consumer goes to the Loan Modification Specialist/Foreclosure Consultant (aka former [or current] Licensed Mortgage Broker).  The company gets the lender in a verbal contract to work with the consumer, then something (anything on the lenders behalf) goes wrong. The MS/FC will report this and the activity, with all evidence to the attorney, who will file a lawsuit, and go before the Judge to get a verdict.  (Examples of something going wrong: Foreclosed, NOTS, different terms presented then originally told)</span></p>
<p>I&#8217;m asking: &#8220;<em>Wouldn&#8217;t this be the &#8220;Rodney King&#8221; method?</em>&#8221;</p>
<p>Oh, and Title Companies?  I think that you should get in on the modification frenzy.  You should not have any problem staying or re-opening.  Call the lenders to see how you &#8220;can be in on the filing of the New NOTES called Modifications or Trial Periods contracts&#8221; that the lenders are having consumers sign.</p>
<p>There is work for all, if we are all willing to become open, honest, and educated!</p>
<p>I loved when President Obama answered [one of the Reporters with] that, &#8220;he was taking his time to become educated before he answered.&#8221; (paraphrased)  We should all learn to do this! For those who were never educated, it&#8217;s called, &#8220;thinking before you speak!&#8221;</p>
<p>It is discouraging that we now have all this software, education, along with all the &#8220;how to&#8221; do modifications at our fingertips, but now need to wait on Attorneys and the Justice System to just blow up with all the stories to admit they need to think before they continue speaking. They will and do admit that they did not know what they were getting into (and still don&#8217;t).</p>
<p>We need to address the fact that we will need the State Licensed Mortgage Brokers and Realtors who did not participate in scamming of the lenders to be involved.</p>
<p>These former licensees who should be employed under the new State guidelines for Foreclosures Consultants remain to stay locked out. As the new job position, the State Licensed Mortgage Brokers, should become the &#8220;new&#8221; State Registered Certified Foreclosure Consultants.</p>
<p>We need the support of the State to make a move on doing what is right for consumers, as well as the citizens of their State, this could be a stimulus in itself.</p>
<p>The Attorneys and the Courts should be waiting on &#8220;Expert Witnesses&#8221; to report the Lenders activities, after checking the Modification file, to see if a lawsuit is necessary.</p>
<p>Although we might not all be able to &#8220;get along&#8221;&#8230; we can work hard together in order to succeed.</p>

<p><em><span style="color: #ff0000;">Does it shortened the period to exercise our right to retain our home?</span></em><span style="color: #000000;"><br />
</span><span style="color: #000000;"> </span><span style="color: #000000;">NO the POA only has to do with permission to speak on your account, ONLY.  There is no adverse affect of a POA, but there are adverse reactions when it is not recognized, as banks often do to third party advocates.</span></p>
<p><em><span style="color: #ff0000;">Ten working days have passed since I have faxed documents that the Lender had required from us.  Is there any response from the Lender?</span></em><span style="color: #000000;"><br />
</span><span style="color: #000000;"> </span><span style="color: #000000;">No.  Responses from the lender are not received after each step and should not be expected. When the information is sent [for review] to the lender, they ask us for 30-90 days to complete this process.  As the old saying goes&#8230;&#8221;NO NEWS &#8212; IS GOOD NEWS! We will accept this as their motto. The lender has stopped all negative activity, so you know that they have received  requested compliance document.</span></p>
<p><em><span style="color: #ff0000;">Please advise us what is our next step to expedite the resolution.</span></em><span style="color: #000000;"><br />
</span><span style="color: #000000;"> </span><span style="color: #000000;">There is no expediting, you are under the lenders control of time. The hardest and only thing you can do right now is &#8220;wait to see&#8221; if the lender has more requests or to wait and see what the lender sends you in the modification package.</span></p>
<p><em><span style="color: #ff0000;">From the time that the property was recorded at the Official Records of [the city I live in] (April 2009), 40 days has passed and we are aware that we have only 50 days left to stop the sale.  What should we do?</span></em><span style="color: #000000;"><br />

<p>We know not everyone has their hands out &#8212; with a few even acting haughty, because they do not want, nor need, any bailout money.  Personally?  I know a lot of people [including ourselves] waiting and wanting this bailout!</p>
<p>The seemingly never ending puzzle is a big to do about nothing.  Who, or shall I say, what, is figuring out where this money goes?  </p>
<p>It will take time to speed forward ahead, but to reverse it all we need be put the State Licensed Mortgage Brokers back to work as Modification and/or Foreclosure Consultants.</p>
<p>Once we put these educated sources back to work with the consumers, the deals that are being underwritten [and verbal confirmations given] will move ahead at a much quicker, desired, speed.  Not all of the Attorneys and Lawmakers understand the guidelines, processes, and underwriting of the money, because it is specific to those who have been licensed, mortgage brokers understand this immediately.</p>

<p>If the closer would have been educated, they should have stated and showed you the three (yes only three) most important documents in that stack of &#8220;RESPAs&#8221;:</p>
<p>1.  Your HUD.  HUD stands for Department of Housing and Urban Development.  What the HUD shows us is the breakdown of the money spent by you, to acquire your loan.</p>
<p>2.  The NOTE.  The Note, will show you the amount you pay each month, who you pay, the Rate &amp; Terms (length of mortgage), whether or not this loan will be an ARM, Fixed or Balloon Mortgage, if there is a Prepayment Penalty, and when the NOTE will &#8220;mature to adjust&#8221; or if it is a Fixed Rate Mortgage.</p>
<p>and</p>
<p>3.  Your Mortgage.  The Mortgage gives the legal perimeters of the loan guidelines, conditions and stipulations, it will also show the amount that [should be the amount] you borrowed, your Lenders Servicing Agreement.  The servicing agreement will let you know if this lender, that you are closing with, will remain your lender.</p>
<p>Would the outcome of your closing have been different, if you would have had the Negative Amortization or Blended Rate explained?</p>
<p>That is a true &#8220;what if&#8221; in hindsight!</p>

<p>The next admiration would go to President Ronald Reagan, to me, he consummated freedom and allowed poor students, as myself, go to school and receive a paycheck for doing it.  He also gave reimbursements for gas, so people did not have to take food from their children and families&#8217; mouths.</p>
<p>As I traveled through Texas at night and I see &#8220;illegals&#8221; running under the highway for freedom and now a wall being built on American soil, it immediately took me back to a famous speech that President Reagan asks Mr. Gorbachev to &#8220;tear the wall down&#8221;.</p>
<p>Do we need to repeat this to President Barack Obama, &#8220;please Mr. President take advise to not forget the past to have the mistake to continue with us.  Remember, memories of President Reagan, and have whoever is behind our &#8220;Great Wall&#8221;, STOP, to tear that wall down!&#8221;</p>
<p>One suggestion (to add to many)<br />
Though many Countries allow a birth in their Country to mean &#8220;automatic&#8221; citizenship.  The U.S. is under horrific times and should put a temporary restraint on children being born in the U. S.  To only be issued a temporary birth certificate, with option for that child to have dual citizenship, and in order for the parents to have a chance to register their child in their heritage.</p>
<p>Of course all those who are legal or waiting on papers in process would be given a temporary Citizenship until their parents are made U.S. Citizens.<br />
Would not this be the least intrusive and most economically sound manner to slow the illegal immigration process if all are truly worried?  There are other ways then building a wall.</p>

<p>I just received an updated report that Bank of America (BOA) is now actively contacting consumers [all of which were Countrywide clients] and acting as though their (Countrywide&#8217;s) records do not exist for them.  They (BOA) are not honoring any approvals at this time [of Countrywide] that were already confirmed to receive a modification for many consumers primary and rental homes.  </p>
<p>This is causing a frenzy of [former] Countrywide clients rushing to their 3rd party advocates office to ask questions to what the lenders are stating to them: &#8220;<em>we have not been contacted by your 3rd party advocate, you are paying for nothing.</em>&#8221;</p>
<div>In my opinion, this is abuse in a different, but still very cruel nature, to consumers&#8230;I say, &#8220;Lenders stop it!&#8221;</div>

<div>3rd Party Advocates and consumers need to beware that certain lenders will act, as if they have amnesia.  Do not get frustrated that the modification process will most likely have to start all over again!  </div>

<div>Oh, but of course, no one has contacted the &#8220;new&#8221; lender on your behalf, they are just now contacting you.  Ask this new ESL if this could be why, your 3rd party advocate has not contacted them, because as you, the consumer, did not know, then the 3rd party advocate could not know.  Don&#8217;t blame the people who are really trying to help you.  We are in this boat together, and no one is going to fall out, if we work together.</div>

<p class="MsoNormalCxSpMiddle" style="margin: auto auto 0pt; line-height: normal; mso-add-space: auto;"><span style="font-size: 12pt; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; mso-fareast-font-family: 'Times New Roman';">Even bigger questions:  Do we need new and updated laws to facilitate these processes?</span></p>
<p class="MsoNormalCxSpMiddle" style="margin: auto auto 0pt; line-height: normal; mso-add-space: auto;"><span style="font-size: 12pt; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; mso-fareast-font-family: 'Times New Roman';">Does this [somewhat] prove that the lending department does not know what their foreclosure department is doing?   Can we start to see that we might need someone (A Real Estate Attorney or the Lawmakers) to say, &#8220;STOP!&#8221;, until we get a handle on this crisis?  What would that harm, on the lending system, who just received a holdover, AKA a bailout, and has a whole inventory of homes to sell as they still take the next?</span></p>

<p class="MsoNormalCxSpMiddle" style="margin: 0in 0in 0pt 0.5in; line-height: normal; mso-add-space: auto;"><span style="font-size: 12pt; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; mso-fareast-font-family: 'Times New Roman';">2.)  Take this REaltors’ (which is who this is) information and correspondence to your Local Police Department.<span style="mso-spacerun: yes;">  </span>File a report for an illegal eviction procedure, taking over your home to sale for profit, illegal process of eviction, and impersonating your lender.  We have reports on how some of the REaltors act when they are conducting this illegal business, so do not forget to label them hostile, if they are rude and overbearing.  Nevertheless, even if they are kind as grandma, this is still an illegal process and you need to act now<em style="mso-bidi-font-style: normal;">!  If you are in a modification process with a 3rd party advocate put that in the police report.</em>  </span></p>
<p class="MsoNormalCxSpMiddle" style="margin: 0in 0in 0pt 0.5in; line-height: normal; mso-add-space: auto;"><span style="font-size: 12pt; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; mso-fareast-font-family: 'Times New Roman';"> </span></p>

<p class="MsoNormalCxSpMiddle" style="margin: 0in 0in 0pt 0.5in; line-height: normal; mso-add-space: auto;"><em style="mso-bidi-font-style: normal;"><span style="font-size: 12pt; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; mso-fareast-font-family: 'Times New Roman';">What this does is blocks this REaltors illegal process.  REaltors are forgetting their professional mannerisms, because of the money they are trying to make while trying to dually be impressive to the lender that hired them.  They need to understand and take a breath… there are lots of homes to sell, leave (y)ours alone.  They also need to understand that they are putting their license and freedom in danger, because once you file with the Police, they <span style="text-decoration: underline;">can be arrested</span> for this improper and illegal eviction and takeover process.</span></em></p>
<p class="MsoNormalCxSpMiddle" style="margin: 0in 0in 0pt 0.5in; line-height: normal; mso-add-space: auto;"><em style="mso-bidi-font-style: normal;"><span style="font-size: 12pt; font-family: &quot;Times New Roman&quot;,&quot;serif&quot;; mso-fareast-font-family: 'Times New Roman';">Your 3rd party advocate if properly trained should know the proper reports to file when you go to their office, so that you may take the reports to the Attorneys.</span></em></p>

<p>Well consumers, it&#8217;s not &#8220;Trick or Treat&#8221; time, it&#8217;s a nationwide survey being conducted by lenders to see, &#8220;who lives here?&#8221;</p>
<p>Even though the majority of the homes that were, or are being sold, are Primary Residences.  With the lenders NOT auditing purchases in the beginning of the process, they are finding that 2, 3 or more homes are claimed to be primary residences.  This is not at the fault of [all] consumers.  Some were straw buyers, with others being investors.  Many of these people are true families who just believed that owning a large home was &#8220;The American Dream&#8221;.  However, to obtain a loan, you had to go to someone who was either licensed, or direct to the Lender, to receive any mortgages.  You might think you knew what you were doing, but you didn&#8217;t know the lenders were setting you up for a fail plan.</p>
<p>Now, many people are trying to avoid that knock, knock, knock at the door.  </p>
<p>If this is your primary residence, don&#8217;t avoid that knock, it&#8217;s okay, it&#8217;s just the lenders, trying to see if this is a &#8220;trick&#8221; loan played on them or really a &#8220;treat&#8221; for yourself being the true owner.  But KNOW THIS CONSUMERS&#8230; if this is your primary residence you do have options! </p>

<p>But, my biggest concern, being civil, is that of the Chief Justices.  </p>
<p>Let me expound just a little&#8230; You know how I have been trying to educate you on the ESLS and some knowledge of this can make your head spin?  Well, think of yourself as though you are a client, who has been educated on RESPA and possible violations, and now think you are at court and how a Chief Justice, who is not educated in the field of mortgage loans, especially not specific to home loans and lending, will react to a possible NINJA loan given out under a Strawbuyer situation.  Or how a SISA, No Doc, Blended 100% LTV, with I/O ARM capabilities will be handled.  Unless the State puts back to work the Mortgage Brokers who can explain to the Chief Justice the new criminal acts of lending, Good Luck getting attorneys to explain correctly.</p>
<p>Homekeepers, LLC is trying their best to stop the foreclosures however they can be stopped, but Citizens&#8217; need to stop thinking HR 3221 - Title V pre-empted the rights of you, the consumer, to have independent State Licensees who are controlled, licensed, and regulated by the States (as a necessary missing piece to the puzzle of this economic crisis).</p>
<p>I would like you to also understand that there are XXX Chief Justices, if any, and XXX,XXX (or more) State Licensed Mortgage Professionals out of work, because the ESLS have [allegedly by me] interrupted the rights of the licensees to be duly compensated and consumers to be protected under the States plan - with them being pre-empted.</p>
<p>With the proper education on the possible new crimes that have been consummated and with past (or present) State Licensees as Mediators/Advocates for the consumers to explain and be expert witness to help point out exactly what the problems were in the loans, most attorneys are still missing the boat.  But there is a chance if we act together now.</p>
<p>If I can explain that a Strawbuyer is someone who the lender allowed to purchase your home because they had better credit than you, and that this became a known practice to lenders, it could change an outcome that many Chief Justice might render.  But if a Chief Justice does not have the education, on the terms that were used buy the ESLS to begin with, then the Chief Justice will side every time with the ESLS foreclosure process.  I know I personally explained to a Judge in a Las Vegas Court and she is allowing us time to get the full evidence to prove the case.</p>

<p>The ESL know more than Santa when coming to find out who is naughty (liars) or nice (truthful).  The ESLs representatives are all over, verifying like crazy.  The God of Housing will not be lied to, at least, not this time around.</p>
<p>&#8220;The Gods&#8221; see (some of) the shady business that might have been conducted in their names, so they are being retro-active.</p>
<p>The ESLs now send a representative to knock on your door.  Most consumers wonder, why?</p>
<p>Because the &#8220;God of Housing&#8221; knows you bought all your properties as owner occupied or as a primary residence.  The representative will knock and ask, “Who lives here?”</p>
<p>Truth is you - the consumer - need to tell the truth, this is a secret to keep your home!</p>

			<content:encoded><![CDATA[<p><img class="alignright size-medium wp-image-109" title="Justice Gavel" src="http://renastarks.com/wp-content/uploads/justice-gavel-200x300.jpg" alt="Justice Gavel" width="200" height="300" />Today I acted as an &#8220;Activist who Advocates&#8221; and went to Court with my client, a Las Vegas consumer, and received a big benefit from a judge. </p>
<p>Our Judge not only recognizes the fact that I am acting as an Activist and an Advocate for consumers in need and NOT acting as an Attorney, he took my word that the ESL told the consumer, &#8220;<em>we cannot help you, because you are not delinquent.</em>&#8221; AND, the Judge understands I, along with Homekeepers, LLC and other Safe Service Providers, are working on a modification plan, because the Foreclosure Division does not speak with the Loss Mitigation Division and no one stopped the sale of the property. </p>
<p>Furthermore, the Judge agreed that there wasn&#8217;t a third-party buyer to the property, only another lender who is acting like a new owner.  The Judge then granted a 30-day &#8220;Stay&#8221;, did not sign the &#8220;Writ&#8221; and that is a big part of the eviction process.  The Judge also told the lenders&#8217; Attorney that &#8220;<em>we have a lot of empty homes already, work it out with the consumer, and come back if necessary.</em>&#8221;</p>
<p>This consumer was turned down by two Attorneys, who felt as though they could not properly represent him.  Hmmm, seems like the Attorneys really know what they are facing with these &#8220;new&#8221; crimes of housing committed. </p>
<p>Education is going to be a bigger key than anyone could have ever imagined.</p>
<p>Yay!  For the ballsy Judges, who say &#8220;<strong>No</strong>&#8220; to wrongful eviction processes, until all questions are answered!  This Judge asked, &#8220;doesn&#8217;t the lender have enough inventory?&#8221;  and &#8220;Can you as an Attorney, state that there was not a process going on that could have saved the consumer their home?&#8221;  Yea!  Ask &#8216;em, make them accountable.</p>
<p>I think I love this Judges&#8217; actions, more Judges need to follower her lead and stop letting the lenders stock up on primary residences as inventory.</p>
<p>Personally, I think that all foreclosure processes should stop until the Realtors have sold what the lenders have in inventory already.</p>
<p>Thank you to the Judges and few who really are accountable to citizens to hold off this process and give an opportunity to work it out.  The lenders will not work it out with consumers unless someone steps up to enforce that they do, oh, before I end, did I thank this Judge?</p>

You do not have to comply.</p>
<p>I want all Realtors to know that we are not TENANTS or <strong><span style="text-decoration: underline;">“Occupants”</span></strong><br />
We are borrowers with more complicated cases, with possible <strong>Straw-buyers</strong> in similar situations.</p>
<p>What is truly insulting Primary Resident holders having positive interacting with the lender in process, not only this, but they are able to have a <strong><span style="text-decoration: underline;">constant contact</span></strong> with the lender and with the lender&#8217;s Attorney.</p>
<p>Besides advocating for others, I have had to advocate for myself.  I could properly speak with both agents, and that’s why we at Homekeepers, LLC work with the client to guarantee a satisfaction and fair process.  There is an advantage in trying to work with the banks in these perilous times.</p>
<p>Consumers:  After you file the report with the Police Department, report this activity to the Modification company so they can notify the Lender that the REALTOR who is [in some cases, breaking into homes and stealing personal belongings, stating, "the lender ordered it." and the lender did not] is being overzealous.</p>
<p>The ESLs are a lot of things but, &#8220;thuggish&#8221;, ha, this has never been the ammo, this is only from what I have witnessed in my past years of experiences.  With all the money that is out there being released (thank you, Mr. President) it is highly unlikely the lenders would blow their chances to really gain, in this event.  Besides, I have had the pleasure of being trained to the level of an Expert by them, and I know they want to work it out.  They do so and are with many companies.</p>
<p>The only two things this posting did, Mr. REALTOR, was first make me say, &#8220;oh Thank God my husband, who had a heart attack in January, is back in the hospital, and did not witness this&#8221; and then, it infuriated me.</p>
<p>What the REALTOR, is doing is trying to pull the shame game.  I work for consumers in a compliant environment, who does not excuse the way you are acting, Mr. REALTOR, you out of order!  If you want to treat home owners this way, learn the rules and guidelines, or become exposed.</p>
<p>I know my lender does not agree with these tactics of postings.  I’ve been in constant contact with my lender and their Attorney.  I am 100% sure they will let me know if a Realtor would need to be involved.  Oh, but make sure to call your modifier to put on record and notify the REALTOR that they cannot come to your home again or you will file proper paper work for Protection Order and put them in jail for impersonating a lender and trying to sell your (and the lenders) home, without authorization.  This shouldn’t be “DEAR OCCUPANT” letters at least give homeowners the respect with a proper title [Dear Victim of Foreclosure].</p>
<p>Consumers, make those who try to evict you identify <strong>who they are</strong> and <strong>who you are</strong>, or they can not threaten to put you out!<br />
If your lenders’ representative is rude in languages to you, report this immediately to the <strong>FDIC &amp; OCC &amp; FTC</strong>.  Lenders do not know that the Representatives are being threatening to you when they call your home, unless you tell them!  The lenders could lose money with this activity.  Report it so we can work together to stop it!</p>
<p>I am right there with you confronting these overzealous REALTORS.  I will use whatever resource and tools that the lenders have taught me to use and that are &#8220;legally&#8221; available to me, to save and preserve both the lenders rights and to not have my rights “pre-empted” In this process.</p>
<p>DO NOT POST on these houses, these families are getting educated, and I will not let acts like this go unexposed!</p>
<p>You are professionals Realtors, not this hired mafia you act as and you need to do the good business you were taught to do, there is plenty of homes on many blocks that are for sale.  Ask the lenders, they have empty homes and empty subdivisions, start with those, not the primary residence where families are trying to live.</p>

<p>As you prepare to leave your family know that your Commander in Chief does not want you to worry, he wants you to know that he has your back.</p>
<p>President Obama released his NEW Plan that will leave you and your family protected.  As you prepare to go off to do battle and protect the US, know this good news, when your lender heard of the new plan, they enlisted.</p>
<p>Thank you, Soldier, for your confidence in Homekeepers LLC. 			<content:encoded><![CDATA[<p><strong>As I sit and hear about the large influx of <a title="Attorney Loan Modifiers" href="http://renastarks.com/topics/attorney-modifiers/">Attorney Modifiers</a>, it makes me laugh, cry, and rant.</strong></p>
<p>I laugh, because unless trained in the Real Estate and Mortgage, attorney&#8217;s do not know <strong>&#8220;how to&#8221;</strong> successfully modify your home loan.  Ask the attorney when you go in to interview.  If they are honest, they will most likely tell you they will use bankruptcy to stop the process.</p>
<p>I cry, because it seems like <a title="Homekeepers, LLC, Loan Modification Company in Las Vegas" href="http://homekeepersllc.com">Homekeepers, LLC</a>&#8217;s and a few other educated consumers know that the <a title="Exempt Status Lender" href="http://renastarks.com/2009/04/08/what-is-an-esl/">ESL</a>&#8217;s have it figured out!   As soon as the <a title="Exempt Status Lender, ESL" href="http://renastarks.com/2009/04/08/what-is-an-esl/"><strong>ESL</strong></a> get the bankruptcy papers they have their Attorney&#8217;s file a &#8220;Relief of Stay&#8221;.   Ask the Attorney &#8220;what do you do for me then?&#8221;</p>
<p>That is what makes me rant, when I see consumers being mislead, AGAIN.   I think that if the United States Government, would have wanted Attorneys to be modification personnel, they would not have come up with the position of Loan Modifiers.  This seems to be one factor everyone is overlooking - the States have already gone though the process to know it is not a good thing for consumers to go direct with the lender, and it is not a good thing to involve an Attorney before you need one for law NOT a modification.</p>

<p><strong>Foreclosure</strong><br />
This event occurs when anywhere from 6months to a year after the NOD is filed. Your lender exercises their rights to proceed on Defaulting on your loan.  This process is announced in a public forum and it is also Notarized and filed in Court.</p>
<p><strong>Notice of Trust Deed Sale</strong><br />
Contractual the lender is letting you know that if compliance is not met then they will sell your home and a date of sale is listed.  Time sensitive.</p>
<p><strong>Deed in Lieu of Foreclosure</strong><br />
You or your agent will contact the lender to go through a voluntary process to return your property to the lender. Doing this saves the bank added expenses associated with the foreclosure process and it will save your credit from having a foreclosure listed on it.  There are specific steps you must take in this process.</p>
<p><strong>Short or Pre-Foreclosure Sale</strong><br />
A short sale is the term used when you owe more money than your home is worth.</p>
<p>The process is called a short-sale because your mortgage holder will accept less than what you owe to settle your debt and note your account as &#8220;paid in full.&#8221;</p>
<p><strong>Verbal Forbearance</strong><br />
This is when you speak to your lender and you “give your word” to pay and consummate the verbal by sending a payment. Danger be careful if you really cannot afford the home why would you make this costly error in judgment.</p>
<p><strong>Formal Forbearance</strong><br />
An agreement negotiated on your behalf or between you and your lender that delays your foreclosure and gives you up to approximately one year to bring your payments up to date.</p>
<p><strong>Refinance</strong><br />
This option requires you to re-qualify for a new loan on your existing home.  NO one has all the criteria levels set for a refinance.  The lenders are working getting this product back.</p>

<p><strong>A Loan Modification fluctuates but, will end with one of these results:</strong></p>
<p>The negative is it could add delinquent amounts due to the lender at the end of your loan balance. The hopes is that it could waive your fees, eliminate penalties, pay off your loan, reduce your interest rate, fix your loan terms, release 2nd mortgages, and in certain circumstances have your principal balances, reduced.</p>
<p><strong>The Modification guidelines fluctuate from lender to lender, it was you must be:</strong></p>
<ol>
<li>Past due on your mortgage, or going to be – Careful some lenders require you to be current</li>
<li>Living in your home (owner occupied), lenders are now working on non-owner properties and 2nd homes</li>
<li>Employed, - declining economics has lead to accept unemployment and other benefits to qualify</li>
<li>Not be in bankruptcy, - Automatically ask the lender to file a “Relief of Stay” or as the Courts to “Release” the lender from the bankruptcy proceedings because of the modification process.  Put the home in the process to release all bad debt from the property</li>
<li>Desire to stay in your home.</li>
</ol>
<p><strong> If you meet these requirements, then you are verbally eligible to begin the Loan Modification review to close process.</strong></p>
